French regulations provide for compensation to persons who resign from their employment in France to follow their spouse or partner who has found work in another country.
- The resignation to follow the expatriate spouse is a legitimate case of resignation that allows you to receive unemployment benefits when you return to France. Indeed, the provisions specific to the French unemployment insurance scheme make it possible to preserve rights to unemployment benefits for a period of 4 years from the date on which the spouse ceases to be employed in France.
- The return and registration as a jobseeker at Pôle Emploi, on which your French residence depends, must therefore take place within 4 years following the end of the resigning spouse's duties in France.
Upon return, several documents must be provided to Pôle Emploi :
- Reasoned letter of resignation
- Documents proving the spouse's activity abroad (employment contract, salary slips)
- Certificate of common residence abroad.
Warning :
This method applies to employees of companies based in France (even if they belong to an international group). The basic principle is as follows : the company "lends" one or more employees to a subsidiary or other company to provide it with a service that is more or less limited in time.
